Appeals Against Rejections
When Home Affairs rejects a visa or permit and the decision can be contested at law.
Home Affairs can reject a visa or permit based on its interpretation and adjudication. Where a rejection is unwarranted and can be contested at law, an appeal is needed.
We prepare a well-formulated application setting out the legal grounds for contesting the decision.
- Appeal, Section 8(4)
- Within 10 working days
- Review, Section 8(6)
- Within 10 working days
When an appeal applies
- You applied for temporary or permanent residence and received a rejection letter giving reasons.
- After assessing the letter, we advise whether to appeal or, if the rejection is correct at law, to prepare a fresh application.
- Appeals under Section 8(4) must be lodged within 10 working days of receiving the decision.
- A review under Section 8(6), the second chance if an appeal fails, must also be lodged within 10 working days.
