Overstay Bans and Appeals

Banned and declared undesirable after leaving on an expired visa? The ban can be appealed.

A foreign national who leaves South Africa without a valid visa, or with an expired one, is given an overstay ban at the port of exit.

Reasons and mitigating factors cannot be argued at the port; immigration officials are obliged to issue the ban. Those reasons do matter, though: they form the basis of the overstay appeal we prepare on your behalf.

How people get an overstay ban

  • A visitor’s visa expires before the visitor leaves the country.
  • A visa extension takes longer than expected, and the person leaves before the new visa is issued.
  • A visa extension is rejected by Home Affairs, and the visa has expired by the time the person leaves.
  • A person stays beyond their visa’s validity, intentionally or not.

How the appeal works

  • People declared undesirable under Section 30(1)(h), read with Section 50(1), of the Immigration Act may submit written representations to the Director-General within 10 working days of receiving the Form 19.
  • Separately, the Minister may waive the ban for good cause under Section 30(2) at any stage. Once the 10 working days have passed, this is the route that remains open.
  • If an appeal has been submitted but receives no attention within a reasonable time, a court order compelling Home Affairs to decide may be the next step. Our legal team will advise you where this applies.

Once an appeal succeeds, you may return to South Africa without waiting for the ban period to end.

  • A copy of your passport
  • A copy of the expired visa
